Participants release and hold harmless Instagram, Facebook, TikTok, Twitter, YouTube, and their respective affiliates, officers, and employees from any and all liability related to the promotion.

Prize Terms

  • blkbrwn reserves the right to substitute prizes of equal or greater value

  • Winners are responsible for all applicable taxes on prizes received

  • Prize fulfillment is the responsibility of blkbrwn; claims regarding non-receipt must be made within 30 days of prize announcement

Affiliate Program

Program Overview

The blkbrwn Affiliate Program ("Program") allows qualifying individuals and entities ("Affiliates") to earn commissions by promoting blkbrwn products on their platforms, websites, social media channels, or through other approved marketing channels.


Participation Requirements

To participate in the blkbrwn Affiliate Program, you must:

  • Be at least 18 years old

  • Not be a current blkbrwn employee or contractor

  • Maintain active, authentic platforms with genuine audience engagement

  • Comply with all applicable laws and regulations

  • Agree to these Terms of Service and the complete Affiliate Program Agreement

blkbrwn reserves the right to reject or remove affiliates who do not meet these requirements.

Commission Structure & Payment

  • Commission rates are established by blkbrwn and communicated to approved Affiliates

  • Commissions are calculated based on qualifying sales generated through your unique affiliate link or code

  • Refunds, chargebacks, and canceled orders result in commission reversals

  • Commissions are paid monthly via the method specified in your Affiliate Agreement (typically 30 days following the end of the month in which sales occurred)

  • Minimum payout thresholds may apply

  • blkbrwn reserves the right to adjust commission rates with 30 days' notice

Affiliate Disclosures & FTC Compliance

CRITICAL: You must comply with all Federal Trade Commission (FTC) guidelines and applicable regulations regarding endorsements and testimonials.

Affiliates must:

  • Clearly disclose your affiliate relationship with blkbrwn in all promotional content

  • Use conspicuous language such as "I earn commissions from blkbrwn" or "#ad" or "#sponsored" on social media posts

  • Place disclosures before the call-to-action to ensure visibility

  • Disclose compensation received (commissions, free products, etc.)

  • Not make false, misleading, or unsubstantiated health or performance claims

  • Not claim personal results or endorsements that you cannot verify with competent and reliable scientific evidence

  • Comply with the FTC Endorsement Guides and any updates thereto


Prohibited Affiliate Practices

Affiliates are strictly prohibited from:

Trademark Bidding: Purchasing or bidding on blkbrwn brand name keywords or trademarks in paid search advertising without express written permission

  • Domain Spoofing: Creating websites, domains, or content that mislead users into believing they are on the official blkbrwn website

  • False Advertising: Making unsubstantiated health claims or guarantees about blkbrwn products

  • Email Spam: Sending unsolicited bulk emails or using purchased email lists to promote blkbrwn products

  • Cookie Stuffing: Automatically redirecting users to affiliate links without their knowledge or consent

  • Deceptive Tactics: Using misleading or manipulative marketing practices

  • Price Undercutting: Promoting blkbrwn products below the MSRP without prior written approval

  • Unauthorized Partnerships: Implying official partnerships, endorsements, or collaborations with blkbrwn without authorization

  • Content Theft: Copying or republishing blkbrwn marketing materials, product descriptions, or images without permission (limited use for promotional purposes only)

  • Competing Promotions: Promoting competitors' products that compete directly with blkbrwn products in the same content or context without disclosure

Affiliate Links & Tracking


  • Affiliate links must be genuine, functional, and unmodified

  • You are responsible for maintaining accurate records of your promotional activities

  • blkbrwn uses tracking technology to attribute sales; you acknowledge that tracking data may not capture all sales and blkbrwn's records are considered final

  • You may not attempt to manipulate, bypass, or circumvent tracking mechanisms

Content & Brand Standards

  • All promotional content must reflect the blkbrwn brand values and quality standards

  • Content must be accurate, professional, and non-defamatory

  • You must obtain blkbrwn approval before creating content that significantly features blkbrwn products or represents blkbrwn's position on health/wellness matters

  • blkbrwn reserves the right to request removal of affiliate content that violates these terms

Affiliate Termination

blkbrwn may terminate your participation in the Affiliate Program at any time, with or without cause, including but not limited to:

Violation of these Terms or the Affiliate Program Agreement


  • Failure to comply with FTC regulations or applicable laws

  • Engagement in prohibited practices listed above

  • Inactivity (no sales or promotional activity for 90+ consecutive days)

  • Negative impact on the blkbrwn brand

  • Completion of any formal complaint or legal action against blkbrwn


Upon termination:

  • Your affiliate link will cease to generate commissions

  • Unpaid commissions will be forfeited if termination results from violation of these terms

  • You must remove all blkbrwn promotional content from your platforms or clearly disclose it as no longer active

Limitation of Liability

blkbrwn is not liable for:

  • Failure of tracking technology to properly attribute sales

  • Delays in commission payments

  • Loss of commissions due to customer refunds, chargebacks, or fraud

  • Changes to commission structures or program termination

  • Any indirect, incidental, or consequential damages related to the Program

Affiliate Independence

As an Affiliate, you are an independent third party. You are not an employee, agent, or representative of blkbrwn. You are solely responsible for:

  • All marketing and promotional activities

  • Compliance with applicable laws and regulations

  • Your taxes and business expenses

  • Any disputes with customers or platforms

Program Modifications

blkbrwn reserves the right to modify, suspend, or terminate the Affiliate Program at any time without notice. Changes to commission rates, terms, or eligibility requirements will be communicated to active Affiliates.


Intellectual Property

All content on this website, including logos, graphics, images, text, and designs, is the property of blkbrwn and may not be copied or used

without permission.

Limitation of Liability

blkbrwn shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or website.

Governing Law

These Terms shall be governed by the laws applicable to the jurisdiction in which blkbrwn operates.
